1. Agreement to Terms

These Terms of Service ("Terms") form a binding agreement between you and Lushbinary Inc. ("Lushbinary", "we", "us", or "our") and govern your access to and use of lushbinary.com (the "Site"), including any content, tools, blog articles, downloadable resources, and services offered through the Site (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. Who May Use the Services

You must be at least 18 years old and capable of entering into a legally binding contract to use the Services. If you are using the Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

3. Professional Services

Custom development, design, AI, and consulting engagements with Lushbinary are governed by a separate statement of work, master services agreement, or other written agreement signed by both parties (a "Services Agreement"). In the event of a conflict between these Terms and a Services Agreement, the Services Agreement controls for that engagement.

4. Content and Intellectual Property

All content on the Site, including text, graphics, logos, images, blog articles, downloadable guides, software, and the overall look and feel, is owned by or licensed to Lushbinary and is protected by copyright, trademark, and other intellectual property laws.

• You may view, browse, and print content for your personal, non-commercial reference.
• You may share links to our pages and quote short excerpts of blog articles with attribution to Lushbinary.
• You may not copy, republish, modify, distribute, sell, or create derivative works from our content without our prior written consent.
• Lushbinary trademarks, service marks, and logos may not be used without written permission.

5. Acceptable Use

When using the Services, you agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose.
• Attempt to gain unauthorized access to the Site, related systems, or other users' accounts.
• Probe, scan, or test the vulnerability of the Site or bypass any security or authentication measures.
• Interfere with or disrupt the Services, including via denial-of-service attacks, excessive crawling, or automated scraping.
• Use the Services to transmit malware, spam, or any other malicious code.
• Reverse engineer, decompile, or disassemble any portion of the Services except where expressly permitted by law.
• Misrepresent your identity or impersonate any person or entity.

6. Third-Party Services and Links

The Site may link to or integrate third-party services (for example, Calendly, analytics providers, and social platforms). Those services are governed by their own terms and privacy policies, and we are not responsible for their content, practices, or availability.

7. AI-Generated and Reference Content

Some Site content, including blog articles, tutorials, benchmarks, and downloadable guides, is provided for informational purposes and may reference third-party tools, models, and companies. We make reasonable efforts to keep information accurate and current, but we do not guarantee that every detail is free from errors or out-of-date references. You should independently verify technical, legal, or financial guidance before relying on it.

8. User Submissions

If you contact us through a form, email, or other channel and send us feedback, ideas, or suggestions, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use that feedback to improve the Services. You should not send us confidential or proprietary information unless we have a separate written agreement covering it.

9. Disclaimers

The Services and all content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Lushbinary disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Services will meet your requirements, that defects will be corrected, or that the Site is free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Lushbinary and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to these Terms or the Services is limited to one hundred U.S. dollars (USD 100). These limitations do not apply to liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Lushbinary and its officers, employees, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or that your use may harm Lushbinary or other users. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue in effect.

13. Changes to the Services or Terms

We may modify the Services or these Terms at any time. Material changes will be reflected by updating the "Last updated" date above, and, where appropriate, by additional notice on the Site. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

15. Privacy

Your use of the Services is also governed by our Privacy Policy and Cookie Policy, which describe how we collect and use information.
